Welcome to PixPop, a service of BluPrynt LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and AI photo generation services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

PLEASE READ THESE TERMS CAREFULLY. BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Eligibility

You must be at least 18 years old to use this Service. To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

By using the Service, you represent and warrant that you are at least 18 years old and meet all eligibility requirements. We do not permit anyone under the age of 18 to use the Service under any circumstances. If we discover that a user is under 18, we will immediately terminate their account and delete all associated data.

2. Description of Service

PixPop provides AI-powered photo generation services. Users upload photographs of themselves, and our artificial intelligence technology generates new images based on those photographs. The Service includes various features such as different styles, backgrounds, and photo packages.

3. Account Registration and Security

• You must create an account to use certain features of the Service
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts at our sole discretion
• You may not share accounts or allow others to access your account

4. User Content and Conduct

4.1 Photo Upload Requirements

When uploading photos, you represent and warrant that:

• The photos are of yourself and no one else, unless you have obtained explicit written consent from any other individuals depicted
• All individuals in uploaded photos are at least 18 years of age
• You have all necessary rights to upload and use the photos
• The photos do not contain nudity, sexually explicit content, or inappropriate material
• The photos do not violate any third party's intellectual property, privacy, or other rights
• The photos are not illegal, fraudulent, or deceptive in nature
• You will not use generated images to create non-consensual intimate imagery of any person
• You will not use generated images for harassment, stalking, bullying, or revenge purposes

4.2 Prohibited Uses

You agree NOT to use the Service to:

• Create images of individuals without their consent
• Generate images depicting minors (anyone under 18 years of age) in any context
• Create sexual, pornographic, nude, or intimate imagery of any person
• Produce non-consensual intimate imagery, "deepfakes," or misleading media intended to deceive others about a person's actions or statements
• Create content for harassment, bullying, intimidation, stalking, or "revenge" purposes
• Generate images intended to damage someone's reputation or cause emotional distress
• Generate fraudulent, misleading, or deceptive content
• Impersonate any person or entity for malicious purposes
• Create content that is defamatory, obscene, or offensive
• Violate any applicable laws, regulations, or third-party rights
• Attempt to reverse-engineer, decompile, or extract our AI models or technology
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers
• Circumvent any security features or access controls
• Resell, redistribute, or sublicense the Service without authorization

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to the photos you upload. By uploading content, you grant us a limited, non-exclusive, royalty-free license to use, process, and store your photos solely for the purpose of providing the Service to you. This license terminates when your content is deleted from our systems.

5.2 Generated Images

Subject to your compliance with these Terms, you are granted ownership and full commercial rights to the AI-generated images created through the Service. You may use these images for personal, professional, and commercial purposes, including but not limited to social media profiles, professional networking sites, marketing materials, and websites.

5.3 Our Intellectual Property

The Service, including its technology, AI models, software, design, graphics, and content (excluding user-generated content), is owned by BluPrynt LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without explicit written permission.

6. Payment and Billing

• All prices are displayed in United States Dollars (USD) unless otherwise specified
• Payment is required at the time of purchase before photo generation begins
• We accept payment via credit card, debit card, and other methods supported by our payment processor (Stripe)
• You authorize us to charge your payment method for all fees incurred
• All purchases are final and non-refundable except as described in Section 7
• Prices are subject to change without notice
• You are responsible for any taxes applicable to your purchase

7. Refund Policy

Due to the computational resources required to train AI models and generate images, all sales are final. We do not offer automatic refunds or money-back guarantees. Refund requests will be evaluated on a case-by-case basis at our sole discretion, considering factors such as technical errors, service failures, or other exceptional circumstances. To request a refund review, contact hello@pixpop.io within 7 days of purchase.

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. AI-Generated Content Disclaimer

You acknowledge and understand that AI-generated images may not perfectly represent your appearance and results may vary. The quality of generated images depends on various factors including the quality, quantity, and variety of uploaded photos. We do not guarantee that generated images will meet your specific expectations or requirements. AI technology has inherent limitations and may occasionally produce unexpected results.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLUPRYNT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless BluPrynt LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) your User Content; or (e) any claim that your use of the Service caused damage to a third party.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Dispute Resolution and Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in Cleveland, Ohio, United States. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and BluPrynt LLC regarding the Service and supersede all prior agreements and understandings.
